Terms of service

These Terms of Service govern the use of the Continuum Business software-as-a-service (the "Service") published by Continuum Identity SAS (the "Publisher"). By signing up for an account, you accept these Terms in full.

1. Definitions

"Customer" means the legal entity subscribing to the Service. "User" means any individual authorised by the Customer to access the Service. "Trial" means the 15-day free trial period offered without payment. "Subscription" means a paid plan beyond the Trial. "Tenant" means the isolated workspace provisioned for the Customer. "Data" means any content uploaded by Users into the Service.

2. Scope of service

The Service is a Customer Relationship Management platform delivered as a SaaS, accessible via web browser. Features available depend on the Subscription tier (Free, Starter, Professional, Business, Enterprise) as published at /pricing.

3. Subscription and renewal

Subscriptions are monthly by default and renew automatically unless cancelled. Annual and triennial commitments are available with a discount and renew automatically at term unless cancelled at least 30 days before renewal.

4. Free trial

The 15-day Trial requires no credit card. At the end of the Trial, the Customer may convert to a paid Subscription or let the account revert to Free tier (limited).

5. Pricing

Prices are published at /pricing in EUR, exclusive of VAT. Volume and engagement discounts apply per published terms. The Publisher reserves the right to revise prices with 60 days written notice; existing Subscriptions are protected until renewal.

6. Payment

Payment is processed by Stripe. Accepted methods: credit cards, SEPA direct debit, and bank transfer for annual / triennial. Invoices are issued monthly (or annually for prepaid commitments) and due upon receipt.

7. Service level

We target 99.5% monthly uptime for Free, Starter, Professional and Business tiers, and 99.9% contractual uptime for Enterprise. Status: status.continuum-business.com.

8. Customer data

Customer Data remains the property of the Customer. The Publisher acts as a data processor and is bound by the Data Processing Addendum (/legal/dpa). Data is hosted in Switzerland by default; alternative residency available for Enterprise.

9. Termination

Either party may terminate a monthly Subscription at any time, effective at the end of the current billing month. Annual / triennial commitments may be cancelled mid-term with pro-rata refund within the first 30 days; thereafter, cancellation is effective at term. Upon termination, the Customer can export full Data within 30 days; Data is then deleted from production systems within 30 days and from backups within 90 days.

10. Liability

To the maximum extent permitted by law, the Publisher's aggregate liability is limited to the fees paid by the Customer in the 12 months preceding the claim. The Publisher is not liable for indirect or consequential damages.

11. Intellectual property

The Service, software, and documentation are the exclusive property of the Publisher. The Customer is granted a non-exclusive, non-transferable licence to use the Service for the duration of the Subscription.

12. Force majeure

Neither party is liable for failure to perform due to events beyond reasonable control, including natural disasters, war, insurrection, internet backbone failures, or government action.

13. Modifications

Material changes to these Terms are communicated by email and take effect 30 days after notice. Continued use of the Service after that period constitutes acceptance of the new Terms.

14. Governing law and jurisdiction

These Terms are governed by French law. Any dispute is subject to the exclusive jurisdiction of the courts of Paris, France.
